John Forbes Ratification (1669)

Ratification in favours of Sir Johne Forbes of Watertoun

Our soverane lord, with advice and consent of his majesties' estates of parliament, hes ratified and approven and, be thir presents, ratifies and approves ane charter and infeftment, granted be his majestie under the great seale, of the date the fourt day of August 1669 yeers, to Sir Johne Forbes of Watertoun, his airs maill and assignays whatsomever, heretablie and irredeimably, off all and haill the lands of Ardgrein and Broomefeild, with multers, sequells, houses, bigings, yeards, tofts, crofts, outsets, tennents, tennendries and service of frie tennents, mosses, mures, marishes, parts, pendicles and haill pertinents of the samen, lying in the parochine of Ellon and shirreffdome of Aberdein; together with the heretable office of constabulary of Aberdein, haill priveledges, liberties, proffeits and commodities belonging to the said office; together also with all and sindrie the teind sheaves of all and sindrie the lands of Carnymux, Borowley, Watishik,† Kirkhill, milnelands thairof, clayhills and fyvielands crofts of Ellon, with parts, pendicles and pertinents thairof, lyand within the parochine of Ellon and shirreffdome of Aberdein forsaid; and of all and haill the lands of Knappernae, with the maynes and maner place thairof, houses, bigings, yeards, orchyeards, tofts, crofts, parts, pendicles and pertinents thairof, milne of Knappernae, milnelands thairof, astricted multers and knaveship of the samen; and of the lands of Corthiemure and siclyk of all and haill the lands of Woodland, the lands of Tullimad, with the sonnie and shadow halff thairof, halff,† bigings, yeards, orchyeards, annexis, connexis, parts, pendicles and pertinents of the samen, all lyand within the said shirreffdome of Aberdein; and likewise of all and haill the lands of Mostoun, with the pertinents of the samen, lyand within the parochine of Logiebuchan and shirreffdome forsaid; and siclyk of all and haill the salmond fishing upon the water of Ithan, alswell in croves as by boats and nets, without diminution or extradonation of the other fishes therof, lyand within the bounds underwritten viz, beginand at Maucherfoord of the said water, and ascending therfra to the seggiefoord of Fyvie, with all and sindrie commodities, priveledges and pertinents thairof, lyand within the barronie of Ogilvie be annexation, and shirreffdome of Aberdein; and lykways of that four rigs of land called the Patons rigs, lyand within the territorrie of Ellon; and of all and sindrie the teinds thairof together with the advocation, donation and right of patronage of the said paroche and paroch kirk of Ellon, personage and viccarage thairof, lyand within the shirreffdome of Aberdein; and siclyk of all and haill the lands of Craig of Allachin, and croft therof called Crawhill; the touns and lands of Over and Nether Ardmores, with all and sindrie houses, bigings and pertinents of the samen, together with the teind sheaves and other teinds, alswell great as small, personage and viccarage, of all and sindrie the saids touns, lands and others abovewritten with the pertinents, lyand of old within the barronie of Allathin, parochine of Ellon and now, be annexation, within the parochine of Wdney and shirreffdome of Aberdein forsaid; and siclyk of all and haill the eister parte of the mains of Pitmedden, of that toun, and lands of Logieruiff, with the lands of milnefeild of Orchyeardtoun, and that sex rigs of beirhill of Orchyeardtoun, with the milne of Logieruiff called the milne of Orchyeardtoun, milnelands, multers, suken, sequells and knaveship thairof viz, the lands,† multers of the saids lands of Logieruiff and Orchyeardtoun and others useit and wont, together with the teinds, alswell personage as viccarage of the saids lands, with all and sindrie maner places, houses, bigings, yeards, tofts, crofts, outsets, mosses, moores, commontie, common pasturage, parts, pendicles and pertinents, tennents, tennendries and service of frie tennents, with frie ingresse and regresse, and haill pertinents belonging thairto conforme to the old rights and infeftments thairof, lyand within the said barronie of Allathin, parochine of Wdney and shirreffdome of Aberdein forsaid, upon the resignation of Johne Kennedies, elder and younger of Carmux, and Johne Moor, therafter of Carmux, Mr William Moir, advocat, and of the said Sir Johne Forbes, himselff; together with the claus of novo damus and claus of new gift and union and erection of the saids lands in ane frie barronie, called the barronie of Ardgrain, for the yeerlie payment of the yeerlie services used and wont, taxed and modified in maner underwritten viz, upon the provision that how oft the saids lands and barronie should fall and become in the hands of his majestie and his successours, be reason of waird, releiff and nonentrie, that nevertheles the said Sir Johne Forbes, his airs maill and assignays, should peaceably brooke and possesse the saids lands and others forsaids for payment to his majestie and his successours of the soume of tuo hundreth punds Scots money yeerlie, dureing the tyme of the said waird, nonentrie and for the releiff, and of the soume of four hundreth punds Scots money for the mariage of the air or airs when the samen should happen, for the payment of the whilk soums the ward, releiff and mariage are disponed to them, in the haill heids, articles, clauses, provisions and conditions of the said charter, with the precept and instrument of sasine following thairupon, and dispositions, contracts and other writts whairupon the samen proceidit, willing and declareing this present ratification to be als valeid and sufficient to the said Sir Johne Forbes and his forsaids as the said charter wer heirin at lenth ingrossed.
